3. What data do we process?
At King of the Road Mallorca S.L. we process the personal data that you provide us with by filling in the forms provided for this purpose on this website, the personal data resulting from the provision or contracting of our services or products and/or the personal data resulting from the commercial relationship that you have with us. In addition, we process personal data that is generated as part of your activities on our website, including your browser data that we receive via the website.


It is important for us to keep the record of your personal data up to date. You are obliged to inform us as soon as possible of any changes or errors in your personal data by contacting us at the following e-mail address: kontakt@triumph-rental-mallorca.com.

 

4. For what purpose do we process your personal data?
Your personal data is processed for the following purposes:

  • Managing and maintaining the services offered via the website.

  • Managing and processing questions and requests for information submitted by users via the contact form. The e-mail address and personal data you provide us with via the contact form on the website will be used exclusively to process the requests you send us in this way.

  • Fulfilment of applicable legal obligations.

  • Manage orders for our services and/or products.

  • To manage requests for information or quotes for our services or products.

5. How long will we keep your personal data?
We will retain your personal data in our systems and files for as long as necessary to fulfil the purposes of the processing and to comply with applicable legislation. Your personal data will be retained for as long as we have a contractual and/or business relationship with you or as long as you do not exercise your right to erasure and/or restriction of processing of your data. The duration of the retention of personal data depends on the purposes of the processing and is generally as follows

  • Personal data that you provide to us when using our services or products will be stored during the contractual relationship and after termination of the contractual relationship for the duration of the limitation period for the resulting legal claims.

  • Personal data that you provide to us for processing information requests or enquiries via the contact form will be stored until you request its deletion or cancellation.

Your personal data will be stored for as long as it is useful for the purposes mentioned, in any case for the duration of the statutory periods and for the time required to take into account possible liability claims arising from the processing.

7. What legitimises the processing of your data?
The authorisation to process your personal data is based on

  • The execution and maintenance of a contractual and commercial relationship with you, such as ordering the company's products and services, managing and obtaining quotes for the company's products and/or services, all in accordance with the provisions set out in Article 6.1.B of GDPR (EU) 679/2016 and Spanish Organic Law 3/2018 of 5 December (LOPDPGDD).

  • Your express consent for one or more purposes, such as the sending of own or third party promotional communications or newsletters, the management of job applications, participation in activities or competitions, all in accordance with the provisions of article 6.1.A of the GDPR (EU) 679/2016 and Organic Law 3/2018 of 5 December 2018 (LOPDPGDD).

  • The fulfilment of various legal obligations, all in accordance with the provisions of Article 6.1.C of the GDPR (EU) 679/2016 and Organic Law 3/2018 of 5 December (LOPDPGDD).

  • The satisfaction of legitimate interests of the data controller or a third party, e.g. for security reasons, to improve our services or to process requests.

The user is informed during the data collection process and at each point on the website where personal data is requested, either via a hyperlink or by appropriate mention in the form itself, whether the personal data requested is mandatory or not.


The personal data requested in the forms on the website are generally mandatory (unless otherwise indicated in the corresponding field) in order to fulfil the purposes specified. Therefore, if the personal data requested is not provided or not provided correctly, the request cannot be honoured.


There is an obligation to provide your personal data when ordering a service or product and/or when requesting a quote or offer.

 

The sending of promotional communications, newsletters or information bulletins about our products and services will be based on the consent you have requested and the cancellation of this consent will in no way affect the contractual or commercial relationship you have with us.

 

If you have given us permission to send you advertising for our services and products, your personal data may be used to manage the sending of advertising offers and newsletters by electronic means. In these cases, the provisions of Articles 20 and 21 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, will apply to the use and processing of your personal data for the purpose of sending advertising by electronic means.

 

If you have ticked the option to receive advertising or if you have subscribed to our newsletter, you can cancel this option at any time.


8. Which recipients will your data be passed on to?

In general, your personal data will not be passed on to third parties outside the company, unless there is a legal obligation to do so. However, we inform you that third parties may have access to your personal data as processors in the context of providing services to the Data Controller. In addition, in cases where there is a legal obligation, the company may assign or transfer personal data in order to fulfil its legal obligations to public administrations.


9. How do we transfer your data?
In order to carry out the data processing activities described above, we may transfer data to countries outside the European Economic Area (EEA) and store this data in physical or digital databases managed by companies acting on our behalf. Database management and data processing is limited to the purposes of the processing and is carried out in accordance with applicable data protection laws and regulations. In the event that data is transferred to countries outside the EEA, the company will take appropriate contractual measures to ensure data protection, which may include contracts based on the standard data protection clauses adopted by the European Commission for the transfer of personal data outside the EEA.

 

10. What rights do you have regarding the processing of your personal data?
You have the right to access your personal data and to request the rectification of inaccurate data or, where appropriate, to request its erasure if, among other things, the data is no longer necessary for the purposes for which it was collected. In certain circumstances, you may request the restriction of the processing of your data. In this case, we will only retain it for the assertion or defence of claims. You may also object to the processing of your data on grounds relating to your particular situation, in which case your personal data will no longer be processed for the purposes for which you have objected. Where technically feasible, you may request the portability of your data to another data controller. To exercise these rights in accordance with current legislation, you can send a letter by post with a copy of a document proving your identity (identity card) to King of the Road Mallorca S.L. You have the right to lodge a complaint with the supervisory authority: Spanish Data Protection Agency (Agencia Española de Protección de Datos www.agpd.es). Origin of the personal data: the data subject himself/herself.
You expressly agree that the personal data collected while browsing the website and/or provided by filling in forms, as well as the data resulting from any commercial relationship, may be included in the company's automated personal data files.
The company guarantees the confidentiality of users' personal data. However, the Company will disclose the personal data and any other information in its possession or accessible through its systems to the competent authorities if required by the applicable legal and regulatory provisions. The personal data may be kept in the files of King of the Road Mallorca S.L., even after the termination of the commercial relationship formalised through the company's website, exclusively for the aforementioned purposes and, in any case, during the legally established periods at the disposal of administrative or judicial authorities.


11. What about the use of social networks?
When you interact with our website through various social networks, for example, when you link to or follow us or share our content on social networks (Facebook, Twitter, LinkedIn, Instagram or others), we may receive information from these social networks, including information about your profile, the user ID associated with your account on the social network and other public information that you authorise to be shared with third parties on the social network.

 

The company uses the social networks to provide information about the services it offers, as well as any other activity or event that it carries out and wishes to publicise. However, at no time do they receive personal data from the users who interact with them, unless there is express authorisation.

 

This data is only used within the social network itself and is not included in any data processing system.


Social networks have their own terms of use and privacy policies, which you must take into account and comply with when using them.


In the event of registration and/or access via a social network account, the Company may collect and access certain information from your user profile on the relevant social network solely for the purposes set out above.
